of Service

Effective: January 1, 2024 Jones Pools — Macon, GA

Jones Pools LLC (“Jones Pools,” “we,” “us,” or “our”) provides pool design, construction, renovation, maintenance, and supply services to residential and commercial clients throughout Central Georgia. These Terms of Service govern all engagements with our business. Please read them carefully — they protect both you and us.

Acceptance of Terms

By requesting a quote, signing a contract, placing an order for supplies or equipment, scheduling a service visit, or otherwise engaging Jones Pools in any capacity, you agree to be legally bound by these Terms of Service and any project-specific contract addenda provided to you in writing.

If you are entering into an agreement on behalf of a legal entity (HOA, property management company, commercial developer), you represent that you have the authority to bind that entity to these terms.

We reserve the right to update these Terms at any time. Material changes will be communicated via email to active project clients. Continued use of our services after notification constitutes acceptance of the revised terms.

Scope of Services

Jones Pools offers the following primary service categories:

  • New Pool Construction: Design consultation, permitting coordination, excavation, gunite/fiberglass/vinyl installation, decking, and final commissioning.
  • Pool Renovation & Resurfacing: Plaster, pebble, and tile refinishing; structural repairs; equipment upgrades; water feature additions.
  • Ongoing Maintenance: Weekly, bi-weekly, or monthly service plans including chemical balancing, cleaning, filter service, and equipment inspection.
  • Supplies & Equipment Retail: Sale of chemicals, pumps, filters, heaters, automation systems, and accessories from our Macon location and via online order.
  • Emergency Repair Services: On-call repair visits subject to technician availability and applicable after-hours rates.

The specific scope of any construction or renovation project will be detailed in a written Project Agreement signed by both parties prior to commencement of work. That Project Agreement supersedes any verbal representations regarding scope, timeline, or materials.

Jones Pools serves Macon, Warner Robins, Milledgeville, Dublin, Perry, Byron, Forsyth, and surrounding Central Georgia communities. Services outside our defined service area may be available subject to a travel surcharge, disclosed in writing before acceptance.

Payment Terms & Pricing

New Construction & Major Renovations

All construction projects require a signed Project Agreement and a non-refundable Design & Engineering Deposit of 10% of the quoted project value prior to any site work, permit applications, or material procurement. Remaining payments are structured as construction milestones, typically:

  • 30% due upon project commencement and mobilization
  • 30% due upon completion of shell/structure
  • 20% due upon mechanical and plumbing rough-in
  • 10% due upon final finish installation
  • Balance due upon final walkthrough and client sign-off

Jones Pools accepts ACH bank transfer, certified check, or major credit cards (a 2.9% processing fee applies to credit card payments on balances over $2,500). We do not accept cash for project balances exceeding $500.

Maintenance Plans

Monthly maintenance plans are billed on the 1st of each service month. Annual plan discounts require payment in full at the start of the service year. Invoices unpaid after 15 days accrue a 1.5% monthly finance charge on the outstanding balance.

Supplies & Equipment

Retail purchases are due in full at point of sale. Special-order equipment (variable-speed pumps, custom automation systems, commercial heaters) require a 50% non-refundable deposit at time of order, as these items are procured specifically for your project.

Price Adjustments

Quoted prices are valid for 30 days from the date of the written estimate. Material cost fluctuations (particularly in gunite, PVC, copper, and chemical commodities) beyond our control may necessitate price adjustments on projects not contracted within the quote validity window. We will always communicate such changes in writing before proceeding.

Cancellation & Change Orders

Client-Initiated Cancellation — Pre-Construction

If you cancel a signed construction project before mobilization begins, the 10% Design & Engineering Deposit is non-refundable. Any costs already incurred by Jones Pools (permit fees, engineering drawings, material deposits placed with suppliers on your behalf) will also be deducted from any additional amounts already paid before a refund is issued.

Client-Initiated Cancellation — During Construction

Cancellation after work has commenced is subject to payment for all work completed to the date of cancellation, all materials procured or ordered, all subcontractor fees incurred, a 15% project management and overhead recovery fee calculated on the total original contract value, and reasonable de-mobilization costs. Jones Pools will provide a detailed accounting within 10 business days of cancellation notice.

Maintenance Plan Cancellation

Monthly maintenance plans may be cancelled with 30 days’ written notice (email to info@jonespools.com is sufficient). Annual prepaid plans cancelled mid-year will be refunded on a pro-rata basis for unused months, less a $75 administrative processing fee. No refund is issued for the current service month in which cancellation notice is received.

Jones Pools-Initiated Cancellation

We reserve the right to cancel or suspend services if: (a) payment obligations are not met after two written notices; (b) site conditions are discovered that make safe execution of the contracted work impossible or impractical; (c) a client or their representatives engage in abusive, threatening, or unsafe behavior toward our staff. In such cases, we will refund amounts paid in excess of work completed and costs incurred, with no additional penalty to Jones Pools.

Change Orders

Any modification to the agreed scope, materials, or design must be documented in a written Change Order signed by both parties before the change is implemented. Verbal approvals do not constitute authorization. Change orders may affect the project timeline and total price. Work added via change order is subject to the same payment milestone structure as the original contract.

Limitation of Liability

General Limitation

To the maximum extent permitted by Georgia law, Jones Pools LLC’s total cumulative liability to any client arising from or related to any service, product, or agreement shall not exceed the total amount paid by that client to Jones Pools in the twelve (12) months preceding the claim.

Consequential Damages

Jones Pools shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of use of your pool or property, lost rental income, damage to landscaping or adjacent structures caused by conditions outside our control, or costs of substitute pool facilities. This limitation applies regardless of whether Jones Pools was advised of the possibility of such damages.

Pre-Existing Conditions

Jones Pools is not responsible for damage to or failure of underground utilities, irrigation systems, septic systems, or other subsurface infrastructure not accurately marked or disclosed prior to excavation. Clients are responsible for engaging Georgia 811 “Call Before You Dig” services and for disclosing all known subsurface conditions in writing before site work begins.

Water Chemistry & Chemical Use

Clients who perform their own chemical additions between scheduled maintenance visits assume full responsibility for any equipment damage, surface degradation, or personal injury resulting from improper chemical use. Jones Pools is not liable for damage resulting from chemical additions not performed by our certified technicians.

Force Majeure

Jones Pools shall not be in breach of any service agreement, nor liable for delays or failure to perform, due to circumstances beyond our reasonable control including acts of God, severe weather, floods, fire, pandemic, government-mandated shutdowns, labor strikes, or material supply chain disruptions. In such events, we will communicate timeline impacts promptly and work with you in good faith to reschedule.

Insurance

Jones Pools maintains General Liability Insurance and Workers’ Compensation coverage as required by the State of Georgia. Certificates of insurance are available upon written request. We strongly recommend that clients maintain their own homeowner’s or property insurance with adequate coverage throughout any construction project.

Warranties & Guarantees

Structural Warranty

Jones Pools provides a 10-year structural warranty on all new gunite pool shells against defects in materials and workmanship under normal operating conditions. This warranty covers cracking or delamination attributable to our construction process. It does not cover damage caused by ground movement (earthquakes, sinkholes, soil settlement beyond industry norms), improper water chemistry maintained by the client, or unauthorized modifications to the structure.

Finish & Surface Warranty

Interior plaster and pebble finishes are warranted for 3 years against defects. Tile work is warranted for 2 years. Surface warranties are void if water chemistry falls outside the ranges prescribed in our Pool Owner’s Guide provided at project completion, or if the pool is drained without prior written approval from Jones Pools.

Equipment Warranty

All equipment installed by Jones Pools (pumps, heaters, automation systems, filters, sanitization systems) carries the manufacturer’s warranty, which we will assist you in registering. Jones Pools additionally warrants all equipment installation labor for 1 year from the date of project completion. Equipment purchased retail from our supply store carries manufacturer warranty only; installation labor warranty applies only when Jones Pools performs the installation.

Renovation & Repair Warranty

Renovation work, resurfacing, and repair services are warranted for 1 year on labor and the specific repaired area. Warranty claims must be submitted in writing within the warranty period. Jones Pools reserves the right to inspect the claimed defect before authorizing warranty repair work.

Warranty Exclusions

All warranties are void in the event of: unauthorized work performed on warranted components by third parties; failure to maintain proper water chemistry and pool care per our provided guidelines; use of the pool for commercial, rental, or high-volume swim school activities unless explicitly approved in the original Project Agreement; and acts of vandalism, misuse, or natural disaster.

Dispute Resolution & Governing Law

Informal Resolution First

We’re a family business and we’d rather solve a problem over a phone call than in a courtroom. Before initiating any formal proceedings, clients agree to contact Jones Pools directly at our contact page or info@jonespools.com and allow us a 30-day period to address the concern in good faith.

Mediation

If informal resolution is unsuccessful, the parties agree to submit the dispute to non-binding mediation in Bibb County, Georgia, administered by a mutually agreed-upon mediator before pursuing litigation or arbitration. Each party shall bear its own mediation costs unless the mediator allocates costs otherwise.

Governing Law & Venue

These Terms and all service agreements shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles. Any litigation arising from these Terms shall be filed exclusively in the Superior Court of Bibb County, Georgia, and both parties consent to personal jurisdiction in that venue.

Contractor’s Lien Rights

Jones Pools reserves all rights available under the Georgia Mechanics’ and Materialmen’s Lien Law (O.C.G.A. § 44-14-360 et seq.) for unpaid balances on construction and renovation projects. Preliminary lien notices may be filed in accordance with Georgia law on all projects exceeding $2,500.

Privacy & Client Data

Your personal information is collected and used solely to provide our services, communicate about your project, and improve our offerings. We do not sell client data to third parties. For complete details on how we handle your information, please review our Privacy Policy.

Site & Digital Use

All content on the Jones Pools website — photography, copy, pool designs, and project documentation — is the intellectual property of Jones Pools LLC or its licensed content providers. Reproduction, redistribution, or commercial use of any site content without express written consent is prohibited. Unsolicited scraping, crawling, or automated data collection from our website is likewise prohibited.

Online quote requests and contact form submissions are not binding contracts. A service agreement only exists when a written Project Agreement or service order is signed by an authorized Jones Pools representative.

Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

Entire Agreement: These Terms, together with any signed Project Agreement and Change Orders, constitute the entire agreement between Jones Pools and the client regarding the services described, superseding all prior oral or written communications.

No Waiver: Failure by Jones Pools to enforce any right or provision of these Terms on one occasion does not constitute a waiver of that right or provision going forward.

Assignment: Clients may not assign their rights or obligations under any service agreement without prior written consent from Jones Pools. Jones Pools may assign its rights to a successor entity in the event of a business merger, acquisition, or sale.
